Application for direct payment of benefit for temporary disability 12/18 months

Pursuant to Articles 169 and 170 of Royal Legislative Decree 8/2015, of 30 October, direct payment for temporary incapacity for 12/18 months consists of the mutual insurance company collaborating with Social Security paying the worker on sick leave, whether due to a common or occupational contingency, directly the amount corresponding to the temporary disability benefit after 365 days of temporary disability, extendable to another 180 days, provided that it is presumed that during this time the worker can be declared fit for work, with the National Social Security Institute (INSS) being the only competent body to determine the worker's situation.

From the day the resolution is determined by this body, the obligation of the company to make social security payments for temporary disability ('subsidised' payment mode). The mutual society collaborating with the Social Security will directly pay the benefit corresponding ('direct' payment mode) during the period from the date of effect of the INSS resolution and until the discharge date. 

Who can request this provision?

Workers protected by Mutua Universal who find themselves in a situation of sick leave, whether due to common or professional contingency, may request direct payment for temporary disability for 12/18 months in the following cases:

  • After 365 days of temporary disability, provided that during this time the worker may be discharged, and from the date of the resolution determined by the INSS and during the period from the date of effect of this resolution until the discharge date.
