Extraordinary Social Security measures extended for self-employed workers affected by the volcanic eruption on the island of La Palma (Article 176 of Royal Decree-Law 5/2023 of 28 June)

On 28 December 2023, the Actual one has been published decree-law 8/2023, of 27 December, through which measures to face economic consequences are adopted and social derived from conflicts in Ukraine and Middle East, as well as to alleviate effects of the drought

In its article 76 are extended until 30 of June of 2024 extraordinary benefits of cessation of the activity for the self-employed workers affected by the volcanic eruption of La Palma. In any case, will be necessary prerequisite credit received corresponding provisions until 31 of December 2023.

Article 76

Provision of cessation of activity for self-employed workers that obliged to stop have been seen in the activity as a result direct of the volcanic eruption registered in the area of Old Summit of La Palma

  1. From 1 January 2024, self-employed workers that they came receiving on 31 December 2023 provisions for cessation of activity as a result direct of the volcanic eruption registered in the area of Old Summit of La Palma, considered in the section one of the article 176 of the Actual one decree-law 5/2023, of 28 June, through which are adopted and they extend certain response measurements to economic consequences and social of the War of Ukraine, back-up to the rebuilding of La Palma island and to other situations of vulnerability; transposing European Union directives involving structural modifications of commercial companies, and work-life balance of parents and caregivers; and of execution and fulfillment of the Law of the European Union; they will go on receiving them, without are counted, for the purpose of to consume established perception maximum periods, the six provision months of cessation of activity considered in this section. Will be considered as a compliment, to effects of being able to access these provisions for cessation of activity, the requirement of contribution, considered in the article 338 of the legislative law of the Social Security Act, approved by the Legislative Royal Decree 8/2015, of 30 October.
  2. These provisions for cessation of activity will be able to begin to yield with effects of 1 January 2024 and they will have a maximum duration of six months, provided that the application is presented within the first veintiún calendar days next on the coming into force of this standard. Otherwise, effects are set in the beginning of the month next on that one of the presentation of the application. The duration of these provisions will not be able to exceed of 30 June 2024.

On 29 June 2023, Royal Decree-Law 5/2023 of 28 June was published, adopting and extending certain measures in response to the economic and social consequences of the war in Ukraine, to aid reconstruction on the island of La Palma and other conditions of vulnerability; transposing European Union directives involving structural modifications of commercial companies, and work-life balance of parents and caregivers; and implementing and complying with European Union law.

Article 176 therein extends until 31 December 2023 the extraordinary benefits for cessation of activity for self-employed workers affected by the volcanic eruption on La Palma. In any case, recipients are required to have received the corresponding benefits until 30 June 2023.

This new extension will take effect from 1 July 2023 and will last for a maximum of six months, provided that the application is filed within 21 calendar days after 30 June 2023. Otherwise, effects are set in the beginning of the month next on that one of the presentation of the application. The duration of these benefits cannot exceed 31 December 2023.

Article 176

Provision of cessation of activity for self-employed workers that obliged to stop have been seen in the activity as a result direct of the volcanic eruption registered in the area of Old Summit of La Palma.

  1. From 1 July 2023, self-employed workers who on 30 June 2023 had been receiving the benefits for cessation of activity as a direct result of the volcanic eruption that occurred in the Cumbre Vieja area of La Palma will continue receiving them, with the six months described herein not counting towards the maximum period for receiving this benefit.
  2. These benefits for cessation of activity may begin to accrue with effect from 1 July 2023, and will last for a maximum of six months, provided that the application is submitted within twenty-one calendar days following the entry into force of this regulation. Otherwise, effects are set in the beginning of the month next on that one of the presentation of the application. The duration of these benefits cannot exceed 31 December 2023.

Extraordinary benefit for cessation of activity for the self-employed workers affected by a temporary suspension of all the activity as a result of the damages brought about by volcanic eruptions.

  1. From 1 July 2023, self-employed workers affected by a temporary suspension of all activity as a result of the damage caused by the volcanic eruption and who had been receiving the extraordinary benefit on 30 June 2023, will be eligible for the extraordinary benefit for cessation of activity provided for herein.

Extraordinary benefit of cessation of activity for those self-employed workers that see affected its activities as a result of the damages brought about by the volcanic eruption registered in the area of Old Summit of La Palma.

  1. From 1 July 2023, self-employed workers whose activity was affected by the damage caused by the volcanic eruption that occurred in the Cumbre Vieja area of La Palma and who had been receiving the extraordinary benefit on 30 June 2023, will be eligible for the extraordinary benefit for cessation of activity provided for herein.
