It regulates the protection system specific for self-employed workers that have temporarily or permanently ceased their economic or professional activity.

What situation protects this benefit?

The involuntary cessation of activity of self-employed workers, farmers or fishermen if they fulfil the following requirements:

  • Have covered the contingency for cessation of activity on the date of cessation of activity.
  • Have contributed for at least the 12 previous month for this contingency.
  • Total cessation of activity.
  • Not of legal retirement age.
  • Be up to date with the Social Security contribution payments.
  • Be registered in the Public Service of Employment.

What are the legal reasons for Cessation of Activity?

  • Financial, technical, productive or organisational:
    • Losses in a complete year higher than 10% of income.
    • Judicial or administrative proceedings for collecting debts that involve at least 30% of the income of the previous year.
    • Judicial statement of bankruptcy that prevents the continuance of activity.
  • Force Majeure.
  • Loss of administrative licence.
  • Domestic violence.
  • Legal separation or divorce agreement in cases of family assistance in the business.
  • For dependent self-employed workers, the reasons are:
    • Ending of the contract.
    • Serious non-compliance by the client.
    • Justified or unjustified rescission by the client.
    • Because of death, disability or retirement of the client.

What does this give me the right to?

  • To a monthly benefit of 70% of the average of the last 12 contributions.
  • To the contribution of the Social Security for Non Work-Related Accident or Disease.
  • To labour training and guidance.

For how long will I receive the benefit?
