Benefit for risk during pregnancy and breastfeeding

In accordance with the regulations (Royal Decree 295/2009), there are two differentiated phases for the examination of the right to the provisions for risk during the pregnancy that of the breastfeeding natural:

Application by the worker for the issuance of the Medical Certificate on the existence of a risk during pregnancy or breastfeeding:

Documentation to present in our Mutua Universal's branches:

  • Application by the worker.
  • Company certificate on the activity carried out and the working conditions.
  • Medical report by a Public Health Service doctor attending to the interested party indicating the state of the pregnancy (week of pregnancy and due date).
  • Work the position risk assessment occupied by the worker.
  • List of work positions exempt from risk.
  • Medical Health Surveillance report (Service Prevention) giving information about the risks in the work position.
  • Photocopy of the National ID card (DNI)/Foreign ID number (NIE).

Once analysed risks of the position of work of the applicant, Mutua Universal will issue a medical certificate in which will learn more about the birth of the right to the provision (in immediate date or in deferred date) or rejection of the grant.

In the event of acceptance, it will first of all be the company's obligation to consider the possibility of changing the worker to a work position that is compatible with her pregnancy. If there is no position compatible with pregnancy, then the application will be made for the benefit.


Application for the benefit by the worker:

Documentation to present in our Mutua Universal's branches:

  • Application by the worker.
  • Company Certificate providing details on the Work-related Injury or Occupational Disease contribution base for the month prior to the suspension of the contract. If the worker is on a part-time or discontinuous permanent contract, the certificate will detail the Work-related Injury or Occupational Disease contribution bases for the 3 months prior to the suspension of the work contract. In both cases, the information is to be complemented with copies of the payslips for the aforementioned periods.
  • Provision of data to the payer for the purpose of the Personal Income Tax Statement (Form 145) and photocopy of the official family booklet.
